For clarification, this isn't pertaining to petty crimes like mugging or shop lifting or some one running away with your pocket book. It pertains to any situation like home invasion, or being confronted by a strange person(s) or anything that may put you in fear of imminent danger to self.
Use of deadly force can be a gun, knife, or physical force fighting to the death.

So long as a person has a clear reason for using deadly force to defend themselves, it should not be a punishable offense. If I ever feel that my life is in danger, you better believe I'm going to fight to the death if I have to.

Ok, I should have read before I voted. I would vote differently under the above circumstances. Hehe that'll teach ya to vote before reading. I got the idea because there are people who were surrounded by gang members that fought them off, one maybe dying, and wound up punished for it. I remember a woman attacking a rapist with her pen, while he was in the process of trying to rape her and the scum bag actually had a lawsuit against her.

That's messed up, if anyone were to try to harm my family or myself, they would be dealing with deadly force. I would not hesitate... It's ridiculous that a judge would even consider siding with someone trying to hurt someone else.

Oh I agree! It makes people who defend themselves from an attacker afraid to go to the police with it afterward.

There was a man in Florida a few years back that was charged w/ attempted murder. He had a winter home and it had been broken into many times. He apparently wasn't getting help from law enforcement so what he did was rig a shotgun with bird shot at ankle level. When someone came through the door (which the burglars had been doing) they would get it in the knees. Well since the burglars didn't technically make it into they door he was able to be charged for attempted murder and sued by the burglars. Apparently had the burglars made it inside he was w/in his rigths to shoot at them. It's been so long that I heard this now I'm wondering if it wasn't an urban legend.

Now that you mention it LC, I think a burglar would be more scared of my dog than me!! She hates strange men especially if my hubby isn't home.

Ill tell you now, someone tries to kill me Im going to kill them first. Same thing with my daughter. Someone EVER attempts to hurt my child and I will go to prison. I have no problem defending the deadly force defense in some situations.

I have no problem defending the deadly force defense in some situations. I hear ya! The poll pertains to those situations when some one truly might feel that their life is in danger of serious injury and/or death. I don't think you should have to go to prison for protecting your child or yourself.

This is an interesting one, The amount of people who are sued over this crap amazes me. Deadly force it seems in reality is determined by the judge on the day in court. I have seen and read cases, where the person in question had every right to kill the wankers who were breaking in, attacking them or whatever, but they were charged with attempted murder, grevious bodily harm or similar such bulls***. If some f***** breaks into your home, then to my way of thinking, he gets buried in the back yard. No questions, no police. Just take care of it yourself. If my wife, kids or even friends were put in this situation, then to me, the individuals who have perpetrated this crime, have lost all rights, as they didnt seem to care about my rights, and they will be dealt with in the hardest manner possible. Gangs on the other hand are a whole dofferent story. As the majority of them are gutless and think they have the respect of the other from behind a gun or a knife, they think they are invincible. hence they travel in well armed packs and more often than not, pick a target that they feel can't do them a lot of damage. If you are confronted with this crap, then you are going to get raped, killed or at the very least stomped or even maimed. I believe you have to go down fighting and fighting hard. If they want what i have then they have to take it from me, and it will cost them. I refuse to lay down and let someone have power over me or my family or friends, and walk away. Here are a couple of facts, proven and worth looking into. If you are closer than 10 feet from a wanker with a gun, it takes him more time to pull it, cock it and aim it before you can be on him. As in most cases, the wankers that hide behind guns havent got the balls to shoot someone anyway this is also a big factor. No you don't know at the time wether he is one of those people, but you have a choice. Stand there and do what they want at gunpoint and then get shot. or make things happen in your favour. A lot of civilians who you would never sispect of heroic acts have done this and have some great stories that they lived to tell. It's not only for the wanna be heroes. Did you know that if someone comes at you with a baseball bat or pool cue, that if you get in close, they can't swing it. Most people that carry weapons rely on the weapon of choice far too much and do not concentrate on the fact that once it becomes useless to them they have no backup. A person with a knife can be overpowered with a towel or hoody. Everything in your hom is a weapon if you choose it to be. Sounds funny but it is true. As I don't like guns, I have knives, and a s***load of them. I have trained Robin in the uses of them also. Now I just have to watch out when I piss her off lol. This subject is becoming more and more relevant, and people really have to start to learn just what it is that they can do to take care of themselves and their families. I have been doing this crap for over 15 years and I can tell you from experience, that the average person, as in you, can do so much more than you think you can when it comes to saving your family. B.

When I lived in Michigan I heard a story about a buglar suing a woman because he fell through her skylight and fell on a knife! The buglar won, and sued the woman for just about everything she had! WTH is this country coming to when you can't even protect yourself or your property?!? Now down south, I believe in Alabama, my fathers camper was broken into, my dad saw the thieves run off. When the police came they asked, "Why didn't you just shoot them? You were in your right too, besides, it would have been less paperwork for us?" !!! It just boggles me.
